TERMS AND CONDITIONS OF SALE

 

1. Introduction

These Terms and Conditions ("Terms") govern the use of this website and the purchase of digital products from Nail Design Library, a commercial brand operated by ERREVU' S.R.L. ("the Company", "we", "us", "our").

By placing an order, you confirm that you have read, understood and accepted these Terms in full. If you do not accept them, you must not place an order.

These Terms should be read together with our Legal Notice, Licence Terms, Refund Policy, Delivery Policy, Privacy Policy and Cookie Policy, which form an integral part of the agreement between us.

3. Definitions

"Customer", "you" — any natural or legal person placing an order through this website. "Consumer" — a Customer acting for purposes outside their trade, business, craft or profession. "Products" — the digital design files, printable transfer templates and related materials sold through this website. "Library" — the complete collection of Products supplied as a single downloadable bundle. "Licence" — the rights of use granted to the Customer under our Licence Terms.

4. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to purchase from this website. By placing an order you confirm that you meet these requirements.

We sell worldwide. You are responsible for ensuring that your purchase and intended use of the Products comply with the laws and professional regulations applicable in your country.

5. The Products

Our Products are digital only. They consist of design files and printable transfer templates supplied in PNG and PDF format, delivered as a downloadable archive.

Nothing is manufactured, stocked or shipped. You are responsible for printing the files and for obtaining all physical materials, tools and equipment required to use them, including but not limited to printers, paper, laminating material or protective sleeves, brushes, nail-art products and curing equipment.

The templates are working guides intended to be painted over by the user. They are not pre-made decals, stickers, water transfers or finished nail products. The finished result is created by the user and depends on their own materials, technique and skill.

Product descriptions, previews, mockups and sample images are illustrative. Printed output may vary depending on printer, paper, colour profile and settings.

6. Orders and Formation of Contract

The display of Products on this website constitutes an invitation to purchase and not a binding offer.

The contract is formed when we send you an order confirmation by email following successful payment. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, payment irregularity, suspected breach of these Terms, or error in pricing or product information. Where an order is cancelled by us, any sum already paid will be refunded in full.

7. Prices and Taxes

Prices are displayed on the website in the applicable currency and are inclusive of any value added tax or equivalent indirect tax due, calculated at checkout on the basis of your country of residence.

As the Products are supplied electronically, no customs duties or import charges apply.

We reserve the right to change prices at any time. Changes do not affect orders already confirmed. Promotional prices apply only for the period stated and cannot be applied retroactively.

8. Payment

Payment is processed at checkout through the payment providers made available on this website. Payment must be received in full before access to the Products is granted.

We do not store or process card details. Payment data is handled directly by the relevant payment provider under its own terms and privacy policy.

9. Delivery of Digital Content

Access to the Products is provided immediately after successful payment, by means of a download link displayed on the order confirmation page and sent to the email address supplied at checkout.

You are responsible for providing a valid email address and for ensuring that our messages are not blocked or filtered. If you do not receive your download link, contact support@naildesignlibrarystore.com and we will resolve the issue.

You are responsible for downloading, extracting and storing the files on your own device. We recommend keeping a personal backup copy.

10. Right of Withdrawal — Digital Content

Under Article 16(m) of Directive 2011/83/EU and Article 59 of the Italian Consumer Code, the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium where performance has begun with the Consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.

At checkout you are required to give that express consent and acknowledgement before completing your purchase. By doing so, you request immediate delivery of the Products and accept that your right of withdrawal is waived once the download is made available to you.

If you do not wish to waive this right, do not complete the purchase.

Customers resident outside the European Union are subject to any equivalent mandatory rights applicable in their own jurisdiction.

11. Refunds

Given the nature of digital content, which is delivered instantly and cannot be returned, all sales are final and no refunds are issued as a matter of course.

We may, at our sole discretion, issue a refund in the following limited circumstances:

• a duplicate charge for the same order;
• a technical fault attributable to us which prevents access to the Products and which we are unable to resolve;
• Products materially different from their description on this website.

Requests must be submitted to support@naildesignlibrarystore.com within 14 days of purchase, with the order number and a description of the issue. Dissatisfaction with the artistic style of the designs, lack of the equipment required to use them, change of mind, accidental purchase, or inability to achieve a desired result are not grounds for a refund.

12. Licence Granted

Subject to full payment, we grant you a non-exclusive, non-transferable, worldwide, perpetual licence to use the Products in accordance with our Licence Terms.

In summary, and without prejudice to the full text of the Licence Terms, you may:

• use the templates to create nail art for paying clients;
• create and sell finished physical products, including press-on nail sets, made using the templates;
• adapt colours, layouts, details and placement in your own work;
• photograph and promote your finished work, with no attribution required.

You may not:

• resell, redistribute, share, sublicense, upload, transmit or otherwise make available the original digital files, in whole or in part;
• extract, isolate or repackage the designs and sell or supply them as digital assets;
• include the files in any other bundle, product, course, membership or collection;
• claim authorship or ownership of the designs themselves;
• use the Products to produce printed decals, water transfers, stickers or any product consisting substantially of a reproduction of the design files;
• register or attempt to register any of the designs, or the Nail Design Library name or logo, as a trade mark or design right.

The Licence is granted to a single individual or single business entity and may not be shared between separate businesses.

13. Intellectual Property

All Products, together with the content of this website, are owned by ERREVU' S.R.L. or used under valid right of use, and are protected by applicable intellectual property law.

Purchase of a Product transfers no ownership of any intellectual property right. Only the Licence described above and in the Licence Terms is granted.

"Nail Design Library" and its logo are registered trade marks of ERREVU' S.R.L. No right to use them is granted under these Terms or under the Licence.

14. Breach and Termination of Licence

We may terminate the Licence with immediate effect, without refund, if you breach these Terms or the Licence Terms, in particular where you redistribute, resell or make the files publicly available.

Termination does not affect our right to pursue any other remedy available at law, including compensation for damages and injunctive relief.

15. Product Use and Safety

You are responsible for selecting appropriate nail-art materials and for using them in accordance with the instructions and safety information supplied by their manufacturers, including curing lamps, UV and LED gel products, markers, adhesives and top coats.

You must avoid contact between uncured products and skin, test any new combination of materials before use on a client, and comply with all professional, hygiene and workplace safety requirements applicable in your jurisdiction.

If you use the Products in the course of a professional activity, you remain solely responsible for your own services, for compliance with the rules governing your profession, and for the safety of your clients.

16. No Guarantee of Results

The Products are design templates. The outcome depends entirely on your own materials, equipment, technique and skill.

We make no representation and give no guarantee as to any particular artistic result, level of skill acquired, commercial outcome, revenue or business result arising from use of the Products.

17. Availability of the Website

We aim to keep this website available at all times but do not guarantee uninterrupted access. Access may be suspended temporarily for maintenance, updates or reasons beyond our control.

18. Limitation of Liability

To the fullest extent permitted by applicable law, our total liability arising out of or in connection with the purchase or use of the Products shall not exceed the amount actually paid by you for the relevant order.

We shall not be liable for indirect or consequential loss, including loss of profit, loss of business, loss of clients, loss of data, or damage to materials, equipment or work product arising from use of the Products.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot be excluded or limited under applicable law, including the mandatory rights of Consumers.

19. Indemnity

You agree to indemnify and hold us harmless against any claim, liability, loss or expense arising from your use of the Products in breach of these Terms or of the Licence Terms, or from any professional service you provide to third parties using the Products.

20. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to failures of internet infrastructure, hosting or payment providers, cyberattacks, power outages, natural events, or acts of public authority.

21. Personal Data

Personal data collected in connection with orders is processed in accordance with our Privacy Policy, which forms an integral part of these Terms.

22. Changes to these Terms

We may amend these Terms at any time. The version in force is the one published on this page at the time your order is placed. Changes do not apply retroactively to orders already confirmed.

23. Severability, Waiver and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Failure to enforce any provision shall not constitute a waiver of that provision or of any other.

These Terms, together with the documents referred to in them, constitute the entire agreement between the parties in relation to their subject matter.

24. Assignment

You may not assign or transfer your rights under these Terms or under the Licence to any third party. We may assign our rights and obligations to a successor entity in the event of reorganisation, merger or transfer of business, without prejudice to your rights.

25. Governing Law and Jurisdiction

These Terms are governed by Italian law, without prejudice to any mandatory consumer protection provisions applicable in your country of residence.

For disputes with Customers acting as Consumers, the competent court is that of the Consumer's place of residence or domicile, where required by applicable mandatory law. For all other disputes, the courts of Pistoia, Italy, shall have exclusive jurisdiction.

Consumers resident in the European Union may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
